If you have been unfairly provided for in a will, or left out completely, you may be able to challenge the validity of the will or make an application for a redistribution of the assets of an estate. Generally speaking, you are eligible for provision from an estate if you are/were:-
• The husband or wife or de facto partner of the deceased;
• A former wife or husband of the deceased;
• A child or grandchild of the deceased;
• A person who was wholly or partly dependent on the deceased (for example, a step-child or foster child);
• A person with whom the deceased was living in a close personal relationship at the time of the deceased's death.
